Marry a foreigner abroad or file for a fiance visa and marry in the US?

I am wanting to marry my boyfriend who lives in Romania, but unsure which path will bring him to the states faster. Should I revisit him and get married in Romania then apply for him to join me in the US? Or should I file for an I-129F, fiance visa, and get married here in the states. I would like to choose the one way which allowes him to enter US the fastest. Any suggestions or past experiences? Thanks.

I129F Fiance’ visa is the fastest. Be sure to prepare your package completely and follow all instructions to the “T”. If you marry abroad the process could take 6 years. Fiance’ visa should take less than 6 months.

Like I stated previously, be sure you meet the criteria, and complete all documents correctly. I don’t believe you need to pay an attorney to do this. I know there are alot of services out there that claim quicker processing if you go through them, it’s a scam. USCIS processes in the order received.

The fiance visa is still the quicker route and probably the easier one as well.

It is true that you can file yourself. I certainly do not recommend going to “immigration consultants” who just fill out the forms for you. However, you may wish to consider a reputable immigration attorney for the following reasons:

If there is anything wrong with the application it will be sent back and, generally, you will lose your place in the line.

You will have to duplicate much of the information, both in the original application and when your boyfriend adjusts status, after marriage. An attorney can deal with that in a breath.

I know people who have done it successfully without an attorney. I hired one and I do not regret doing so.

Clearly the Fiance visa would be ‘fastest’ because you could start it today.
A spouse visa will require you to go abroad and get married.

There is a lot more to it than ‘fastest’ and you should remember: haste makes waste.
You don’t get a lot of chances to correct errors in this process; if you are going to do it yourself, make sure you find a good family based immigration discussion group to augment what the uscis.gov site tells you.

Fiance visa is safer you live with them and have 3 months to marry them and if it doesnt work out they go back

File the I-129f,and get married here in the USA.This usually takes about 6 months according to immigration.Hiring an attorney is not really necessary.If you follow the directions closely and provide them with all the proof they request,you shouldn’t have any problems.If you make a mistake,they will send you everything back and you will lose your place “in line.”Good luck,Romanian guys are so HOT !

I was told that fiancee visa only last for 3 mths. I would get the paper work filed while he can come over to the US with a tourist visa get married and send in the paper work as soon as you get married. He can stay in the US even if his tourist visa is expired as long as his paper work is being processed. Remember if you apply for his visas in a bigger city it takes a longer time so if you are from a smaller city that would benefit you too..

http://www.visajourney.com is the place to go to find free information on the best way forward for you and him. Go there, read the guides and then ask questions in the forums where you can find people who have been through the process or are still in the middle.
Do not take the risk of having him come here on a tourist visa and try to beat the system as you will both have trouble trying to prove that you didn’t plan to marry when he came here.
A fiance visa does only last for 90 days, that’s plenty time to get married and file for the next stage is the immigration process.

It’s up to you, do what you think is best.

I’m British so it may be slightly different, but me and my Albanian husband applied for a Fiance Visa first and then married in Britain a few months later. This was better for us as it gave us time to make proper wedding arrangments.
